The stress of a divorce is hard enough without having to fight with your lawyer to do what you need him/her to do. Before you decide to find another lawyer, though, consider that maybe your lawyer is fighting for you and knows what is best. After all, your attorney is experienced with family law!
The first step you should take is to talk to your lawyer. Explain your concerns and let your attorney tell you his/her side of the story. It is possible that your emotions are getting in the way of you thinking clearly and your attorney is trying to help you. Lawyers need clients who will recommend them to others and are generally not going to go against your wishes without a sound reason.
If you are still not satisfied with your attorney, sit down and try to figure out what exactly is bothering you about the situation. Are you and your spouse trying to have an amicable divorce and your attorney trying to make you fight for more? That would be a good reason to look for another lawyer as it sounds as if that person just wants a larger fee.
Has your spouse written up an agreement and your lawyer is advising you not to sign it? Then you may want to listen to your lawyer. Obviously, something in the agreement isn’t right or they would not be telling you not to sign. Maybe something is missing and your attorney noticed. It is understandable that you want to get the divorce over with as quickly as possible, but this document will affect the rest of your life. Your lawyer is protecting you.
At times, you and your lawyer may not “click.” This is a person that you have to trust completely with intimate details of your life and if you don’t feel comfortable sharing everything, you may need to look for another attorney. Some personalities just don’t mesh together into a trusting relationship. It is up to you whether you want to continue with your attorney or look for another one.
